If a person is arrested for drunk driving and they refuse to take a blood or breath test, this can be used against them in court and may result in harsher penalties and a longer period of license suspension. For a first DUI offense, a person may face one day to a year of jail time, $350-$5,000 in fines, minimum 90 day license suspension and probation. For a second DUI offense, a person may be sentenced to 30 days to a year in jail, electronic home monitoring, $500-$5,000 in fines, 2 year license revocation and probation.
