DUI (driving under the influence) charges can be filed against a person if they are found to be operating a motor vehicle or in physical control of a motor vehicle with a blood alcohol content (BAC) of .08 percent or higher. It is very important to note that you can still be arrested for DUI if your driving is impaired at a lower BAC percentage. If a person is arrested for drunk driving and they refuse to take a blood or breath test, this can be used against them in court and may result in harsher penalties and a longer period of license suspension. For a first DUI offense, a person may face one day to a year of jail time, $350-$5,000 in fines, minimum 90 day license suspension and probation. For a second DUI offense, a person may be sentenced to 30 days to a year in jail, electronic home monitoring, $500-$5,000 in fines, 2 year license revocation and probation.

As with any other type of criminal offense, the severity of the sentence will depend on the extent of your crime. With DUI charges, the higher a person’s BAC and the more drunk driving charges that are on their record, the harsher the penalties will be if they are convicted.
