The most serious is rape in the first degree, as described in Washington Criminal Code 9A.44.040 as engaging in sexual intercourse with another person by force, when the offender:
- Uses or brandishes a deadly weapon or an object appearing to be a deadly weapon;
- Kidnaps the victim;
- Causes serious bodily injury to the victim; or
- Commits a felony by entering the building or vehicle where the victim is present.
Rape of the first degree is a class A felony. If a defendant is convicted of this offense, he or she may face up to life in prison along with a fine of up to $50,000.
